Ord 31 Annexing 45.788 acres in Denton CountyORDINANCE NO. 31 AN ORDINANCE RECEIVING AND ANNEXING TERRITORY ADJACENT AND CONTIGUOUS TO THE TOWN OF WESTLAKE, TEXAS; PROVIDING THAT SUCH AREA SHALL BECOME A PART OF SAID TOWN AND THAT THE OWNERS AND IN- HABITANTS THEREOF SHALL BE ENTITLED TO ALL THE PRIVILEGES OF OTHER CITIZENS OF SAID TOWN, AND BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND TO BE HEREINAFTER ADOPTED; FURTHER PROVIDING FOR AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF SAID TOWN AS HERETOFORE ADOPTED AS AMENDED, AND PROVIDING FOR AN EFFEC- TIVE DATE. WHEREAS, pursuant to the provisions of the Acts of 1953, 53rd Legislature, Page 357, Chapter 93, codified as Article 974-G, Revised. Civil Statutes of Texas, Rolling Green Company, Inc., a Texas corporation, owner of the real property hereinafter described having made application as by law pro- vided to the Mayor and Board of Aldermen of the Town of West- lake, Texas, requesting annexation of the lands lying within a 0.1287 square mile tract, more or less, out of the W. H. Pea Survey, A-1045, and the J. R. Michael Survey, A-821, Denton County, Texas, and being more fully described by metes and bounds as follows: A 45.788 acre tract out of the northeast corner of the W. H. Pea Survey, A-1045 located in Denton County, Texas and a 35.581 acre tract out of the southeast corner of the J. R. Michael Sur- vey, A-821, located in Denton County, Texas, and described as follows: BEGINNING at the intersection of the east line of said Pea Survey and the west line of the J. Henry Survey, A-528, with the northeast right- of-way of State Highway No. 114 and Present Corporate Limits of the Town of Westlake, Texas, said oint also being the southeast corner of said 5.788 acre tract; _ THENCE N 700 501 W with the northeast right-of- way of said State Highway and said corporate Limits 1480 feet more or less to the southwest corner of said 45.788 acre tract; THENCE North with a fence and crossing the north line of said Pea Survey and the south line of said Michael Survey, 2520 feet more or less to the south line of a County Road at the northwest corner of said 36.581 acre tract; THENCE S 780 201 E along the north line of said 36-581 acre tract and the south line of said County Road 366 feet more or less to an angle corner therein; THENCE S 890 27' E with the north line of said 36.581 acre tract and the south line of said County Road 1060 feet more or less to the north- east corner of said 36.581 acre tract, said point being a corner in the Present Corporate Limits and in the east line of said Michael Survey, and the west line of said Henry Survey; THENCE South with the line between said Henry, Michael and Pea Surveys 2890 feet more or less to the point of Beginning and containing a total of 82.369 acres or 0.1287 square miles. A plat of said land showing its location with respect to the Town of Westlake, Texas, being attached hereto marked EXHIBIT "All; WHEREAS, said petition was filed with the Town of Westlake at 9:00 A.M. on October 26, 1964 , which is not less than five and not more than thirty (30) days prior to this date; and WHEREAS, it appearing to the Board of Aldermen of the Town of Westlake, Texas, that all statutory requirements in connection with said proposed annexation have been ful- filled and that the said area duly grouped into one territory is not more than 1/2 mile in width and that all of same is adjacent to the present Town Limits of the Town of Westlake, Texas; BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: 1. THAT, the property hereinabove described being adjacent and contiguous to the Town Limits of Westlake, Texas, be and is hereby annexed and brought within the Cor- porate Limits of said Town and is hereby made an integral part thereof. 2. THAT, the owners and inhabitants of the area herein annexed be entitled to all of the rights and privileges of other citizens and property owners of said Town and be bound by all of the acts and ordinances made in conformity thereto, now in full force and effect and that which may be hereafter adopted. 3. THAT, the official map and boundaries of the Town of Westlake, Texas, as heretofore adopted and amended, be and is hereby amended so as to include the aforementioned territory as part of the Town of Westlake, Texas. 4. THIS Ordinance shall become effective and be in full force and effect from and after its passage and approval by the Mayor and duly attested by the Town Secretary. GREETINGS: The undersigned, Rolling Green Company, Inc., a Texas corporation, hereinafter called Petitioner, represents as follows: 1. That Petitioner is the owner of the lands lying within an 82-369 acre tract of land consisting of 45.788 acres out of the W. H. Pea Survey, A-1045, Denton County, Texas and 36.581 acres out of the J. R. Michael Survey, A-821, Denton County, Texas, fully described by metes and bounds as shown in Exhibit "A" attached hereto. A plat of said land showing its location with r--- spect to the boundary of the Town of Westlake, Texas, is attached hereto marked Exhibit "B". 2. That, the land described in EXHIBITS "Alt and "B" hereto attached, is less than one-half mile in width; that less than three qualified voters reside thereon, and is contiguous and adjacent to the Town of Westlake, Texas. 3. Your petitioner agrees that if this request for annexation be granted, said land and any future inhabitants there- of shall be entitled to all the rights and privileges of other citizens of the Town of Westlake, and shall be bound by the acts and ordinances of said Town, now in effect and as hereafter enacted.
