Res 57-01 Ordering a General Election on the First Tuesday in April of Each YearRESOLUTION NO. 1 WtfEREAS, pursuant to the provisions of Title 28, Chapter 11, of the Revised Civil Statutes of Texas, it is provided that there shall be hold in each Municipality in the State of Texas on the first Tuesday in April of each year, a general election for the purpose of electing officers of said municipality: NOW, T_IEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERKEN OF THE TOWN OF WESTLAKE, TEXAS: 14 THAT the Board of Aldermen of the Town of Westlake, Texas, at a regular meeting .held this date, does hereby order an election of Officers for the Town of Westlake, Texas, to be held on Tuesday, April 2, 1957, for the purpose of electing a Mayor, Five Aldermen and a Marshal, for a term of one year, from April 1, 1957, or until their successors are duly elected and qualified. The candidates for Mayor, Alderman and Marshal, receiving the highest number of votes shall be elected: to such offices for a -term of one yepr. IT FOR the Durpose of said election, the entire Town is hereby constituted one voting precinct; the polling place for said election shall be the Headquarters Building,,Circle 'ET" Ranch, within said Town, and said election shall be held between the hours of 7:00 A.. and said 7:00 P. ANY eligible and qualified person may have his name printed upon the official ballot as an independent Candidate for the offices herein provided for by filing his sworn application with the Mayor not later than Midnight, March 2, 1957. The application shall state the specific office being sought by the applicant and that the applicant is eligible and qualified under the Laws of the State of Texas, to become a can- didate for and hold the office being sought, if elected. V. (A) The form of the sworn ap?lication shall be substantially as follows: To the 1'iayor of the Town of Westlake, Texas, Greetings: I, , hereby make application to .have my name printed on the official ballot as an independent can- didate for the office of _, to be voted upon at the Town Election to be .held on the 2 day of April, 1957, and I hereby certify that I have resided in the State of Texas for at least one year and in the Town of Westlake, Texas, for at least six months prior to the date of such elec- tion, and am qualified to make this application and that I am legally qualified to hold such office, if elected. (B) Such sworn application may be accompanied with a petition signed by qualified electors, although such petition is not required. (C) Such sworn application shall be accompanied with an executed copy of the "Loyalty =rffidavit" as required by Article 6.01 "2'1951 Election Code in Vernon's Texas Civil Statutes, in substantially the following form: "I, , of the Town of Westlake„ Texas,. Any Candidate for either of the offices herein provided for may have his name printed upon the ballot on application to the Mayor, such application to be furnished by the Town Secretary and that same shall contain the signatures of five (5) percent of the qualified voters of tine Town, of the entire votes cast in the Town at the last general election, which application small be accompanied by the loyalty affidavit as hereinabove set out. VII. The names of all those who have filed their sworn applications t have their names printed on the official ballot as well as those that are nominated by petition, as candidates small be posted by the Town Secretary in a conspicuous place at the office of the said Secretary for inspection of the Public for at leastthirty (30) days before the date of said Election. The Town Secretary shall preserve for a period of two years all applications, petitions and other related papers. -. 3 VIII. Any person eligible to the offices herein provided for who has filed his sworn application in accordance with the provisions of this resolution, or who is nominated to any office by petition, shall have his name printed on the official ballots. Any such person may cause .his name to be withdrawn at any time before the official ballots are printed, by filing in writing with the Town Secretary a. request to that effect over .his signature, duly attested to by a Notary Public. No name so withdrawn shall be printed on the ballots. IX. The ballots to be used in said election shall be -prepared in the manner and fora as provided in the election code of the State of `texas enacted by the 1951 Legislature. X. All qualified voters within the meaning of the constitution and Laws of the State of Texas, who have resided in the State of Texas for a period of one year, and in the To;an of Westlake for a period of six months prior to the date of the election herein provided for shall be entitled to vote at such election. XI. Voting by absentee ballot in said election siaall commence on March 12, 1957, at the office of the Town Secretary, Westlake, Texas, Voting by absentee ballot shall close at five P. Y-, March 30, 1957. XII. The election officers above named sc_a.11 make and deliver the returns of said election in triplicate, one being retained by the presiding Judge, one delivered to the Mayor of the 'Town, and one delivered to the Town Secretary. The ballot box containing the signature stubs from ballots used in said election shall be delivered to the District Clerk of Tarrant County, Texas, and other ballot boxes and election records and supplies shall be preserved by the Town Secretary inthe proper office as by law provided. The Board of Aldermen will meet not less than five and not more than seven days following said election for the purpose of canvassing the returns of said election. XIII. The Mayor is hereby directed to give notice of said election which shall be signed by the Mayor under the attest of the Town Secretary, and shall state the purpose of the election, the Officers to be elected, and the Marsh&l shall post a properly executed copy of the election proclamation at the polling place herein provided and tv — 4 copies at two other public places within the Town. Such notices shall have attached thereto a certified copy of this resolution. XIV. Said election shall be held and conducted in accordance with the laws of the State of Texas for the holding of general elections for State and Coulty Offices except as otherwise provided by Chapter 11, Title 28, and the 1951 Election Code of the Revised Civil Statutes of Texas.
