Happ Keller PD Traffic Division GOLF CART •Texas Law defines a Golf cart as a motor vehicle designed by the manufacturer primarily for use on a golf course. Sec 551.403 of the Transportation Code •Limited Operation: •An operator may operate a golf cart : •1) in a master planned community: •A) that has in place a uniform set of restrictive covenants; and •B) for which a county or municipality has approved a plat; Continued •Can be used on a public or private beach (Doesn’t Apply here) •3) On a public highway for which the posted speed limit is not more than 35 miles per hour, if the golf cart is operated: •(A) During the daytime; AND •(B) NOT more than two miles from the location where the golf cart is usually parked AND FOR TRANSPORTATION TO OR FROM A GOLF COURSE. Sec. 551.404. OPERATION IN MUNICIPALITIES AND CERTAIN COUNTIES, the governing body of a municipality may allow an operator to operate a golf cart on all or part of a public highway that: •(1) is in the corporate boundaries of the municipality; and •(2) has a posted speed limit of not more than 35 miles per hour. •(a-1) In addition to the operation authorized by Section 551.403, the commissioners court of a county described by Subsection (a-2) may allow an operator to operate a golf cart on all or part of a public highway that: •(1) is located in the unincorporated area of the county; and •(2) has a speed limit of not more than 35 miles per hour. •(a-2) Subsection (a-1) applies only to a county that: •(1) borders or contains a portion of the Red River; •(2) borders or contains a portion of the Guadalupe River and contains a part of a barrier island that borders the Gulf of Mexico; or •(3) is adjacent to a county described by Subdivision (2) and: •(A) has a population of less than 37,000; and •(B) contains a part of a barrier island or peninsula that borders the Gulf of Mexico. Continued •(b) A golf cart operated under this section must have the following equipment: •(1) headlamps; •(2) taillamps; •(3) reflectors; •(4) parking brake; and •(5) mirrors. GOLF CARTS IN CONCLUSION •In order for a golf cart to be on the roadway in the Town of Westlake without the golf course being your destination: •1. The city to authorize its use. •2. Appropriate equipment that was listed above. •3. Insurance. •Golf Carts might be a more convenient mode of transportation but take into consideration the safety of the passengers, cars provide far better protection for the ones we love. Golf Carts were never designed to be involved in an accident with a motor vehicle. Recreational OFF-Highway Vehicle "Recreational off-highway vehicle" means a motor vehicle that is: •(A) equipped with a seat or seats for the use of: •(i) the rider; and •(ii) a passenger or passengers, if the vehicle is designed by the manufacturer to transport a passenger or passengers; •(B) designed to propel itself with four or more tires in contact with the ground; •(C) designed by the manufacturer for off-highway use by the operator only; and •(D) not designed by the manufacturer primarily for farming or lawn care. Recreational OFF-Highway Vehicle Sec 663.037 Operation on public roadway prohibited •. (a) A person may not operate an off-highway vehicle on a public street, road, or highway except as provided by this section. •(b) The operator of an off-highway vehicle may drive the vehicle across a public street, road, or highway that is not an interstate or limited-access highway •This section only allows for vehicles to be used for agricultural work, utility work being conducted by the utility company or by EMS or Law enforcement personnel. Sidewalks •(16) "Sidewalk" means the portion of a street that is: •(A) between a curb or lateral line of a roadway and the adjacent property line; and •(B) intended for pedestrian use. •NOT THE ABOVE LISTED VEHICLES!! This is a violation!! What other vehicles apply to this? In Conclusion •Golf Carts that are owned by Vaquero, issued to residents or the golf course, are not to be operated outside of the property lines of Vaquero Club. •Use of any of the above listed vehicles in the Town of Westlake is a ticket -able offense. •Allowing an unlicensed driver to operate one of these vehicle is also an offense.
