Ord 869 Approving a Concept Development Site Plan for Charles Schwab Phase 2 TOWN OF WESTLAKE ORDINANCE NO. 869 AN ORDINANCE OF THE TOWN OF WESTLAKE AMENDING ORDINANCE 770; AMENDING THE ZONING BY APPROVING A CONCEPT/DEVELOPMENT PLAN AND SITE PLAN AMENDMENT FOR AN APPROXIMATELY 81.06-ACRE AREA OF PLANNED DEVELOPMENT DISTRICT 3, PLANNING AREA 5B (PD3-5B). THE PROPERTY IS GENERALLY LOCATED SOUTH OF STATE HIGHWAY 170, NORTH OF JT OTTINGER ROAD, AND WEST OF WESTLAKE PARKWAY. PROVIDING A PENALTY; PROVIDING A CUMULATIVE CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AUTHORIZING PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS,the Town of Westlake, Texas is a general law municipality; and WHEREAS, the Town Council of the Town of Westlake finds it necessary for the public health, safety and welfare that development occur in a controlled and orderly manner; and WHEREAS,in February 2016,the Town Council approved Ordinance 770 establishing the approximately 81.06-acre Planned Development District 3, Planning Area 5B (PD 3-5B) zoning district; and WHEREAS, there is located within the corporate limits of the Town of Westlake an approximately 81.06-acre tract of land known as Planned Development District 3, Planning Area 5B (PD 3-5B), bounded by JT Ottinger Road to the south, Westlake Parkway to the east, and State Highway 170 to the north, depicted in attached Exhibit A; and WHEREAS,because of the size,location,and natural features of Planned Development District 3, Planning Area 5B (PD 3-5B) and the Town's need for public infrastructure, amenities, and economic development, the Town has a critical interest in the development of Planned Development District 3, Planning Area 5B (PD 3-5B) and is encouraging such development to the highest possible standards of quality consistent with the Town's long-term development vision; and WHEREAS, in May 2017, the Town Council approved Ordinance 826 approving the approximately 33-acre Concept/Development Plan for Charles Schwab Phase I as found in Planned Development District 3, Planning Area 5B (PD 3-5B); and WHEREAS, in May 2017, the Town Council approved Ordinance 827 approving the approximately 33-acre Site Plan for Charles Schwab Phase I Planned Development District 3, Planning Area 5B (PD 3-5B); and Ordinance 869 Page 1 of 5 WHEREAS, in May 2017, the Town Council approved Ordinance 828 approving the approximately 33-acre Preliminary Site Evaluation for Charles Schwab Phase I Planned Development District 3, Planning Area 5B (PD 3-5B); and WHEREAS, in September 2018, the Town Council approved Resolution 18-34 approving the approximately 33-acre Charles Schwab Phase I Lighting and Signage Plans for Planned Development District 3, Planning Area 5B (PD 3-5B); and WHEREAS,the Planning and Zoning Commission recommended to the Town Council approval of the plans depicted in attached exhibits on October 15, 2018, subject to certain specific conditions; and WHEREAS, following provision of proper legal notice, including written notice to owners within 200 feet of the subject property,published notice and posted notice in accordance with the Texas Open Meetings Act of public hearing, a public hearing was held on October 29, 2018, by the Town Council; and WHEREAS, upon the recommendation of the Planning and Zoning Commission, the Town Council of the Town of Westlake, Texas, is of the opinion that it is in the best interests of the Town and its citizens that the plans depicted in Exhibits B, C, D and F should be approved and adopted. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That all matters stated in the preamble are found to be true and correct and are incorporated herein as if copied in their entirety. SECTION 2: That Ordinance 770 of the Town of Westlake, Texas, is hereby amended by this Ordinance amending Planned Development District 3, Planning Area 5B (PD 3-5B), described and depicted in attached Exhibit A. PD 3-5B shall be subject to the plans shown in Exhibits B through E. SECTION 3: That the Town Council of the Town of Westlake, Texas does hereby approve the plans shown as attached exhibits and located in PD 3-5B,which is an approximately 81-acre tract located south of Hwy 170, west of Westlake Parkway, and north of JT Ottinger Road, as reflected in Exhibit A, also attached hereto. The plans shown on Exhibits B through E are approved subject to the following conditions: 1. A variance to the maximum height restriction of 735MSL established by Ordinance 770 and shown on Exhibits C and D of this ordinance is hereby granted for DFW-4. 2. Prior to the issuance of building permits, a final landscaping plan for the Phase 2 campus shall be submitted and require the approval of the Town Manager or their designee. Prior to the issuance of building permits, a final lighting plan for the parking garage (DFW-G2) and parking lots depicted on Exhibits C and D shall be submitted and require the approval of the Town Manager or their designee. 4. All outdoor lighting must comply with the lighting fixtures as approved by the Town Council found in Resolution 18-34 and Town of Westlake outdoor lighting ordinances. 5. All signage must comply and be consistent with the signs as approved by the Town Council found in Resolution 18-34. 6. The property owner shall submit a development agreement for all approved development in the PD3-5B zoning district. Said development agreement shall be executed not later than the issuance of the final Certificate of Occupancy for Schwab Phase I construction approved by Ordinance 827. 7. The campus, as depicted on Exhibits C and D,may be accessible to the public at the discretion of the property owner. 8. Per the park land dedication requirements in the Code of Ordinances, the developer shall dedicate 1.114 acres to the Town of Westlake as part of this development. Said dedication shall be executed not later than the recording date of the final plat for the subject property. These terms may be further defined and/or amended as part of the required development agreement between the Town and the developer. SECTION 4: That this Ordinance shall be cumulative of all other Town Ordinances and all other provisions of other Ordinances adopted by the Town which are inconsistent with the terms or provisions of this Ordinance are hereby repealed. SECTION 5: That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Code of Ordinances of the Town of Westlake, and upon conviction shall be punishable by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6: That any person violating any provision of this Chapter may be issued a citation and upon conviction thereof, the person shall be deemed guilty of a misdemeanor and punished as provided in subsection 1-9 of the Code of Ordinance of the Town of Westlake. Each 24-hour period of violation,and each separate act or condition in violation of this Chapter, shall constitute a separate offense. SECTION 7: It is hereby declared to be the intention of the Town Council of the Town of Westlake, Texas, that sections, paragraphs, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared legally invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such legal invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance since the same would have been enacted by the Town Council of the Town of Westlake without the Ordinance 869 Page 3 of 5 incorporation in this Ordinance of any such legally invalid or unconstitutional,phrase, sentence, paragraph or section.
