Res 18-13 Approving a Site Plan in Planned Development PD 3-11 for Spec's Addition TOWN OF WESTLAKE RESOLUTION NO. 18-13 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS, APPROVING AND AMENDING A PLANNED DEVELOPMENT SITE PLAN OF AN APPROXIMATELY 2.044-ACRE PORTION OF PLANNED DEVELOPMENT DISTRICT 3,PLANNING AREA 11 (PD 3-11), ESTABLISHED BY ORDINANCE 593 FOR THE PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF SH-170 AND US HWY 377, COMMONLY KNOWN AS WESTLAKE CORNERS NORTH SUBDIVISION. THE PD SITE PLAN SHOWS AN ADDITION TO THE SPEC'S WINES, SPIRITS & FINER FOODS LOCATED MORE SPECIFICALLY AT 2431 US HWY 377. WHEREAS,the Town of Westlake, Texas is a general law municipality; and WHEREAS, Ordinance 593 established Planned Development District 3, Planning Area 11 (PD3-11); and WHEREAS, Resolution 10-44 established the site plan for the original Spec's Wines, Spirits and Finer Foods store located at 2431 US Hwy 377; and WHEREAS, the Planning and Zoning Commission voted unanimously to approve this site plan on March 12, 2018; and WHEREAS, the Town Council finds that the passage of this Resolution is in the best interest of the citizens of Westlake. NOW, THEREFORE,BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That, all matters stated in the Recitals hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. SECTION 2: That the Town of Westlake Town Council does hereby approve the Planned Development Site Plan, attached as Exhibit A, subject to the following conditions: a) All comments from the property owner's association must be addressed before the issuance of any building permits for the Spec's Addition. b) The applicant must receive written approval from the property owner's association (Hillwood Properties) before the issuance of any building permits for the Spec's Addition. c) Lighting fixtures must reduce the number of lumens per lamp in order to reduce the number of foot-candles at the property lines where appropriate. Resolution 18-13 Page 1 of 2 d) The retail fagade signage and business monument signage must exclude the Spec's Rabbit/Bunny logo to match the already existing signage on the store. SECTION 3: If any portion of this Resolution shall, for any reason, be declared invalid by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and the Council hereby determines that it would have adopted this Resolution without the invalid provision.
