Commission presentation Planning & Zoning Commission Meeting December 18 , 2008 12/18/2008 Background ® Began in late `07, early '08 • Why? • Barnet Shale activity in urban areas • Balance between "mineral estate rights" with "surface owner rights" • Current ordinance allows gas well drilling only in one zoning district, two parcels (OI) • Additional Council direction in May `08 ® October `08 — Council consideration of ordinance conceptual framework • Public input meeting: November `08 r� 12/18/2008 Tonight's Consideration: 0 A Zoning Ordinance Amendment ONLY * Would allow a "gas well pad site" in any zoning district IF a SPECIFIC USE PERMIT (SLIP) is approved • What is a SLIP? • A type of discretionary zoning change where additional specific conditions can be placed on a specific use and parcel 12/18/2008 Prolposed Zoning Ordinance Amendment: • Expands districts in which gas well pad sites mav be located, but only with an approved SLIP. • But it's not guaranteed. • Why? • SLIP Process Itself: • Two public hearings (at least) • Adjacent property owner notification • Conditions imposed on SLIP can be rigorous 0 ►, s KI What this Proposed Amendment Does:, • It expands the districts in which the applicant can ASK for an SLIP. • The SLIP, if granted, is still subject to all of the Technical Standards Ordinance requirements PLUS conditions imposed for the SLIP itself. 0 12/18/2008 The SLIP is not all that would be r _uired ® Two Pronged Approach: ® SLIP involves a hearing before both P&Z and Town Council ® Technical Standards Ordinance 1 . Establishes a process for applying for "gas well pad site permit" Must first have an approved SLIP 2. Establishes a process for applying for "gas well permit" 12/18/2008 The Permit Process: A Site Plan will be required for each Gas Well Pad Site. This Site Plan will become an exhibit for the permits issued subsequently.
